This comprehensive seminar will address key contractual provisions and provide an alternative to form agreements for practitioners on small projects. The seminar will be presented by David B. Kosakoff, Esq., LEED AP, the Managing Partner of Kosakoff & Cataldo, and Michael W. Spinelli, Esq., AIA, an architect and Of Counsel with Kosakoff & Cataldo. Together, they have decades of experience dealing with construction projects and apply their background to address significant issues that Architects should be aware of when negotiating contracts. Included in the seminar will be a Terms and Conditions prototype for use by attendees in their practice.

Construction projects are typically plagued with a variety of issues that can create problems for project participants. This seminar will address the need to provide a clear definition of responsibilities to avoid confusion and potential problems on work site. Through examples of actual projects, the presenters will provide practitioners with guidance to effectively navigate client relationships and avoid potential conflicts that can plague a project and have serious consequences to design professionals.

Learning Objectives
1. To provide Architects with a practical guide to address responsibilities of project participants.
2. By developing a clearly defined contract and associated Terms and Conditions, the Architect can educate his/her clients and manage their expectations which can avoid confusion that often leads to conflicts during construction.
3. By incorporating various contract terms, the Architect can effectively navigate complications and minimize exposure that can otherwise lead to service consequences that typically arise on construction projects.
4. Specific terminology can be particularly helpful to all participants to the project who will be better prepared to assume well defined responsibilities for the betterment of timely and effective project completion.
